This is a patent suit, coming from the Northern District Of California, Judge van fleet.

The suit is based on U. S. Letters - patent no. Granted Oct. 4, 1904, to Peter C. Nielsen, for Horns for Phonographs or Similar Machines. Claims 2 and 3 only are in issue.

The interlocutory decree of the Court below sus tains said Claims 2 and 3 as valid and infringed, and awards an injunction and an accounting.
